TERMS AND CONDITIONS

1. Definitions
“Photographer” refers to the sole trader providing photography and/or videography services.
“Client” refers to the individual or entity booking the Photographer’s services.
“Services” refers to all photography and/or videography services provided.
“Deliverables” refers to all images, video footage, edits, and final materials supplied. 

2. Booking and Payment
2.1 A booking is confirmed only upon receipt of a non-refundable deposit as agreed in writing.
2.2 The remaining balance must be paid in full prior to or on the day of the shoot, unless otherwise agreed.
2.3 Failure to make payment may result in cancellation of services and withholding of Deliverables.

3. Cancellation and Rescheduling
3.1 Deposits are non-refundable except at the Photographer’s sole discretion.
3.2 Rescheduling requests must be made with reasonable notice and are subject to availability.
3.3 The Photographer reserves the right to cancel due to illness, emergency, or circumstances beyond control. In such cases, liability is limited to a full refund of monies paid.

4. Copyright and Usage
4.1 The Photographer retains full copyright ownership of all images and video produced, in accordance with the Copyright, Designs and Patents Act 1988.
4.2 The Client is granted a non-exclusive, non-transferable licence for personal or agreed commercial use, as specified at the time of booking.
4.3 The Client must not alter, edit, or apply filters to the Deliverables without prior written consent from the Photographer.
4.4 The Client must not sell or distribute the Deliverables for profit unless expressly agreed in writing.

5. Photographer’s Usage Rights
5.1 The Photographer reserves the right to use any images or video for portfolio, marketing, promotional materials, social media, website display, and competition purposes.
5.2 If the Client wishes to restrict usage (e.g., for privacy reasons), this must be agreed in writing prior to the shoot and may incur an additional fee.

6. Artistic Style and Editing
6.1 The Client acknowledges that the Photographer’s work is delivered in a consistent artistic style.
6.2 Editing, colour grading, and overall presentation are subjective and at the Photographer’s sole discretion.
6.3 The Photographer is not obligated to provide unedited (RAW) files unless explicitly agreed in writing.

7. Delivery of Work
7.1 Delivery timelines are estimates and may vary depending on workload and circumstances.
7.2 Final Deliverables will be supplied in agreed formats via digital download or other agreed method.
7.3 The Photographer is not responsible for storing or archiving files beyond a reasonable period after delivery.

 

8. Client Responsibilities
8.1 The Client must ensure all necessary permissions are obtained for locations, venues, and individuals being photographed or filmed.
8.2 The Client is responsible for the behaviour of all participants during the shoot.
8.3 The Photographer reserves the right to cease work if unsafe, inappropriate, or illegal behaviour occurs.

 

9. Liability Limitation
9.1 The Photographer shall not be held liable for failure to deliver Services due to circumstances beyond reasonable control, including but not limited to:

  • Equipment failure

  • Loss or corruption of digital files

  • Illness or injury

  • Acts of God, weather, or venue restrictions

9.2 In the event of total failure to deliver due to such circumstances, liability is limited to the return of any fees paid.
9.3 The Photographer is not liable for any indirect, consequential, or incidental damages, including loss of business, reputation, or opportunity.
9.4 The Photographer is not responsible for injury, loss, or damage sustained by any person or property during the shoot, except where caused by proven negligence.

 

10. Force Majeure
The Photographer shall not be liable for any failure or delay in performing obligations where such failure results from events beyond reasonable control, including natural disasters, strikes, pandemics, or government restrictions.

 

11. Complaints and Issues
11.1 Any concerns must be raised within 7 days of delivery of the Deliverables.
11.2 The Photographer will make reasonable efforts to address valid concerns but is not obligated to provide refunds or re-edits beyond agreed terms.

 

12. Data Protection
12.1 Personal data will be handled in accordance with applicable UK data protection laws, including the UK GDPR.
12.2 The Photographer will not share Client data with third parties except where necessary to fulfil Services.

 

13. Entire Agreement
These Terms and Conditions constitute the entire agreement between the Client and the Photographer and supersede all prior agreements.

 

14. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of England and Wales.

15. Acceptance
By booking the Photographer’s services, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
